1. The Promotion
The [Chinese New Year – Free Charger Promotion] (the "Promotion") is organised by BYD Automotive. By participating, claimants agree to be bound by these Terms and Conditions.
2. Promotional Period
The Promotion commences at [14 February, 2026] and concludes at [28 February, 2026] ("Promotional Period").
Limited Time Only: This offer is strictly time-bound. Any purchases made outside of the Promotional Period will not be eligible for the offer.
3. Eligibility Requirements
To be eligible for this Promotion, participants must:
Purchase a qualifying product ([ BYD Sealion 5 or BYD Sealion 8]) from an authorised retailer during the Promotional Period.
Complete the purchase in full (including delivery or registration, if applicable) by [31 March, 2026]
4. The Offer (The "Gift")
The Offer consists of a BYD 11kW AC Charger. In South Australia, an alternative AC charger of equivalent Recommended Retail Price (RRP) and compliant with South Australian regulatory requirements will be supplied.
Availibility: Gifts are subject to stock availability. The Promotion is "while stocks last."
Non-Transferable: The Gift is not transferable, exchangeable, or redeemable for cash, credit, or discounts on the vehicle purchase price.
5. Redemption Process
The Gift will be provided within 14 days of delivery completion at point of sale.
BYD Automotive reserves the right to verify the validity of all claims and disqualify any claimant who tampers with the process.
6. General Conditions
Single Use: This offer is limited to one (1) Gift per qualifying purchase.
Exclusions: This Promotion cannot be combined with any other active fleet discounts, government rebates (unless specified), or existing dealership vouchers.
Modification: BYD Automotive reserves the right to cancel, terminate, modify, or suspend the Promotion if the fraud, technical failures, or any other factor beyond the Organizer’s control corrupts the administration or security of the Promotion.
7. Limitation of Liability
To the extent permitted by law, BYD Automotive is not responsible for any faulty hardware (e.g., chargers), installation issues by third parties, or any loss or damage resulting from the use of the Gift.
8. Consumer Guarantees (The "Non-Exclusion" Clause) Statutory Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
9. Accuracy & Non-Deceptive Conduct
Inventory Transparency: "This Promotion is limited to 1000 units nationally. Once this stock is exhausted, the Organizer is under no obligation to provide an alternative gift or price reduction, unless required by law."
Fair Representations: "The Gift is provided 'as is' at the time of delivery. While the Organizer takes care to ensure the Gift matches its description, the visual representation in marketing materials is for illustrative purposes only."
10. Warranties Against Defects
Warranty Claims: "In addition to your rights under the ACL, the Gift may come with a manufacturer's warranty. To make a claim, please contact your purchasing dealership. Our liability for a breach of a condition or warranty implied by law is limited to the replacement or repair of the goods.
For customers in South Australia, an alternative charger brand will be supplied in place of the BYD 11kW AC Charger. Any manufacturer warranty claims relating to chargers supplied in South Australia must be directed to the relevant charger manufacturer using the customer care details provided at the time of charger delivery."
11. No "Change of Mind" Exclusion
Returns Policy: "The Gift cannot be returned or exchanged for 'change of mind.' This does not affect your rights to a repair, replacement, or refund under the Australian Consumer Law if the product is faulty or does not match its description."
